As per registry remark dated 06.10.2017 respondent Nos. 1 and 2 have served. No one is appeared on behalf of aforesaid respondents.
Heard on I.A. No. 8489/2017 has been filed for condonation of delay under Section 5 of Limitation Act.
In this case, it appears from the first calculation sheet that office had pointed out two defaults in this case. As per default number first, it was
mentioned that the limitation shall be calculated after filing of the certified copy of order. The second default was related to the incorrect valuation of
appeal.
In the margin of the order sheet, it is stated that default has been removed. The record shows that certified copy of the award has been filed.
Thereafter, it was the duty of the office to calculate the period of actual delay in fling the appeal.
Therefore, Registrar (Judicial) is directed to calculate the actual delay in fling this appeal and list this case with the aforesaid remark, after one week.
Thereafter, the application for condonation of delay may be considered.
