Heard the learned counsel for the appellant.
The present appeal has been filed by the appellant-Bank under section 18 of the SARFAESI Act against the interim order dated 12.01.2023 passed by the DRT, Dehradun in S.A. No. 71/2021, by which the Tribunal below has called for explanation from the concerned authority for intentional violation of the order dated 05.12.2022 passed by the Tribunal below.
Learned counsel for the appellant contends that there is no violation of the order passed by the Tribunal, therefore, no contempt can be drawn and the Tribunal below has wrongly summoned the senior officer of the Bank and sought clarification.
Learned counsel for the appellant may move an appropriate application before the Tribunal below bringing the facts, which he wants to bring before the court to show that there has been no violation of the said order, who may consider the same in accordance with law.
In view of the above, the appeal stands disposed off.
