Jaswant Singh, J.—Prayer is u/s 482 Code of Criminal Procedure for quashing of FIR No. 199 dated 22.12.2004 under Sections 420 IPC registered with Police Station Sector 3, Chandigarh and charge framed u/s 420 IPC and Section 24 of the Immigration Act on the basis of compromise dated 22.02.2005 (Annexure P-2).

This Court vide order dated 22.09.2010 had permitted the parties to get their statements recorded in terms of the compromise. Report has been received from the court of learned JMIC,

Chandigarh wherein it is stated that the complainant party is not residing in India since last four years and they are not available for getting their statements recorded.

In view of the aforesaid situation when complainant is not available for getting his statement recorded, compromise is not possible and petition is ordered to be dismissed at this stage with the liberty to the Petitioner to file another petition as and when the parties are available.

Disposed of in the above terms.
