Inderjit Singh vs State of Punjab

Inderjit Singh, petitioner, alongwith his brother Kamaljit Singh was granted industrial loan by the Punjab Financial Corporation to the tune of Rs. 23,10,000/. The first instalment of this loan to the tune of Rs. 13,87,000/ was payable on 671988. Unfortunately, aforesaid Kamaljit Singh died on 2461988 and on 6th July, 1988, Inderjit Singh petitioner, alongwith some other person who impersonated as Kamaljit Singh executed mortgage deed in favour of the Corporation and obtained the first instalment of loan. The petitioner has refunded the major portion of the loan.

The learned counsel for the state contends that the petitioner is required for investigation purposes in order to ascertain the identity of the impersonate and that the petitioner had failed to join the investigation.

The petitioner has disclosed the name of the impersonator as Charanjit Singh, the brotherinlaw of Kamaljit Singh since deceased in this petition itself. The learned counsel for the respondentState states that in fact Charanjit Singh had filed a complaint in this regard before the Financial Corporation & thus the petitioner is implicating Charanjit Singh on that score. The investigating agency has not so far got opinion of the handwriting expert in order to ascertain whether aforesaid Charanjit Singh had appended the signatures of Kamaljit Singh deceased on the mortgage deed while obtaining the loan.

Under these circumstances, the petitioner is directed to be released on bail in the event of his arrest on furnishing requisite bond to the satisfaction of the Investigating Officer. The petitioner is present in the Court and he is directed to join the investigation on 1971990 at 1000 AM at Police Station Division No. 5, Ludhiana and continue joining the investigation as and when required to do so but the entire period of joining the investigation shall not exceed 14 days.
