Judgment
Suvir Sehgal, J
At the outset, on joint request of counsel for the parties, main petition is taken on Board.
CWP-14009-2009 (O&M)
Although, response to the miscellaneous application (CM-6795-CWP-2025), filed by respondent No.4, is awaited, but counsel for the petitioners states that as there is an alternate remedy of filing an appeal, petitioners may be relegated to take recourse to the same and interim protection granted by this Court vide order dated 10.09.2009, be continued till the disposal
Counsel for respondent No.4 does not have any objection. He states that a similar course was adopted in a connected petition bearing CWP-2072-2008. He has referred to the orders passed in the aforesaid petition, which have been reproduced in the civil miscellaneous application.
As requested by counsel for the petitioner, he is permitted to withdraw the writ petition with liberty to file an appeal under Section 79 of the Haryana Regulation and Registration of Societies Act, 2012.
Dismissed as withdrawn with liberty as aforesaid.
Let the petitioner avail aforesaid remedy within a period of one month from today. In case he does so, interim order passed by this Court on 10.09.2009, shall continue till the disposal of the appeal.
Pending application stands disposed of.
