Judgment
This is a Transfer Application seeking transfer of the Case from the District Commission (East), Saini Enclave, Delhi to the District Commission (North), Tis Hazari Courts, Delhi on the ground that the matter is not being taken up at the District Commission (East) and secondly one of the newly appointed Members of the District Commission (East) has secured her appointment unlawfully on the basis of fake and fabricated documents. The request therefore is that the Case be transferred to the District Commission (North) as the learned President who heard the matter in the District Commission (East) till 2021 is posted there. The Applicant had already filed a Writ Petition before the Delhi High Court that was dismissed.
The allegation is that the Applicant (the Complainant) has lost faith in the District Commission (East) Delhi and therefore the Case may be transferred to the District Commission North, Tis Hazari Courts, Delhi. This Application was moved on 10.01.2022 and the composition of the District Commission (East) might have changed with the appointment of new Members. Even otherwise, the Applicant does not seem to be interested in pursuing this matter as no one has put in appearance in this Transfer Application since March, 2022 as per the Order Sheets dated 13.05.2022, 12.09.2022, 29.12.2022 and 22.03.2022.
In the absence of the learned Counsel for the Applicant, this Transfer Application being misconceived even otherwise is rejected.
