Judgment
Justice Kurian Joseph, C.J.—The Writ Petition is filed mainly with the following prayers:
i) That the impugned order dated nil, Annexure P-7 passed by Respondent No. 5 may kindly be set aside;
i) That if during the pendency of writ petition, the petitioner is thrown out of job on the basis of impugned order dated nil at Annexure P-7, in that event such termination of the services of the petitioner may also be set aside and he may be held entitled to all consequential reliefs.
The matter pertains to P.T.A. appointment. At paragraph 12 of the reply, it is admitted by the Addl. Deputy Commissioner that ����� the petitioner�s version was not heard during the enquiry���.� In several cases this Court has taken the view that the affected party should be associated in the enquiry. Therefore, the impugned orders are quashed. It is made clear that the judgment shall not stand in the way of the Enquiry committee conducting appropriate enquiry in accordance with law after associating the petitioner also.
With the above observations, the Writ Petition is dismissed, so also the pending application(s), if any.
