This application has been filed by the Respondent Company seeking dismissal of the present appeal that is Company Appeal No. 04/252/ND/2019 filed by the Income Tax Department under Section 252 of the Companies Act 2013. It is submitted by the Ld. Counsel appearing for the Respondent That the Respondent No. 2 Company has already paid all the dues against all the demands including interest/Penalty as on 10.12.2023 including assessment year 2011-12. The Income Tax Department has issued an NOC to that effect.
He therefore prays that the present appeal filed by the Income Tax Department may be dismissed since no Income Tax dues are pending for recovery. Mr. Puneet Rai, Ld. Senior Standing Counsel appearing for the Income Tax Department on instruction has submitted that there are no objections. We may note that the Company Appeal No. 04/252/ND/2019 was heard and order was reserved on 16.08.2023.
In view of the statement made by the Ld. Counsel the Company Appeal 04/252/ND/2019 is dismissed.
