Heard. Applicant Inam, who is in jail in connection with Crime No. 12 of 2012, relating to offence punishable u/s 8/18 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Mussoorie, District Dehradun, has sought his release on bail.
Seventy Kilograms of poppy husk powder (DODA) said to have been recovered from the present applicant. Minimum commercial quantity of said contraband item prescribed under the Schedule is fifty kilograms. Learned counsel for the applicant submitted that there is no public witness of the alleged recovery. It is further submitted that applicant has no criminal history. It is further pleaded that the applicant is Kabadiwala. In the above circumstances, without expressing any opinion, as to the final merits of the case, this Court is of the view that applicant deserves bail. The bail application is allowed. Let the applicant Inam, be released on bail, on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the court concerned.
