Judgment
Heard Mr. Ghosh appearing on behalf of the respondent no.2 â€" applicant.
It is submitted that respondent no.2 â€" applicant was enlarged on bail by this court in CRA No.720 of 2016 on condition that he shall appear before
the trial court once in a month till the disposal of the appeal. Pursuant to such order, respondent no.2 â€" applicant was enlarged on bail and he is
regularly appearing before the trial court.
Under such circumstances, it is submitted that direction given upon him to appear before the learned Chief Judicial Magistrate, Hooghly vide order
dated 5.1.2018 in the present appeal be waived.
In view of the aforesaid submission particularly the fact that respondent no.2 â€" applicant is already on bail, we modify the direction upon him vide
order dated 5.1.2018 and direct him to appear before the Chief Judicial Magistrate, Hooghly at Chinsurah once in a month till the disposal of the
appeals.
CRA 720 of 2016 shall be heard along with CRA 181 of 2017.
The application being CRAN 610 of 2018 is, accordingly, disposed of.
Let a plain copy of this order, duly countersigned by the Assistant Registrar (Court), be handed over to the party upon compliance of requisite
formalities.
