Judgment
The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.
The petitioner says that intermediate quantity of ganja was allegedly recovered from the possession of the petitioner and the maximum sentence that the petitioner can suffer is of six months.
The petitioner claims to have been in custody for nearly 118 days. Considering the material against the petitioner and the circumstances, there may not be any further need to detain the petitioner as long as the petitioner does not leave the State without the permission of the investigating officer till the time that the investigation is completed or the permission of the trial court upon the completion of the investigation. Subject to the above, the petitioner will be released on bail upon furnishing security of Rs.20,000/- (Twenty Thousand Only) together with personal release bond of equivalent value to the satisfaction of the appropriate court in Howrah. It will also be incumbent on the petitioner to attend every date fixed for trial and any unexplained absence will entitle the trial court to cancel the bail without reference to this Court.
