Petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through Video Conference.

This is an application under Section 439 of the Code of Criminal Procedure praying for release of the petitioner on interim bail.

The petitioner was arrested in connection with G. R. No. 1588 of 2020 in respect of alleged offences under Sections 354D/500/292 of the Indian Penal Code read with Section 67A of the I. T. Act. The petitioner is under judicial custody as stated in the application for 32 days and has completed 55 days as on date.

Investigation is still on and the learned counsel for the State submits that the petitioner should be directed to attend investigation and the police station regularly.

Considering the nature of the offences alleged against the petitioner and the fact that he is in custody for 55 days as on today, the petitioner is granted interim bail on production of two sureties of Rs.25,000/- each. The other terms and conditions of bail shall be stipulated by the learned ACJM at Malda.

The petitioner undertakes to appear before the Investigating Officer as and when summoned and in default of any appearance before the Investigating Officer, report shall be forthwith submitted before the ACJM, Malda, who shall be at liberty to cancel the bail.

It is expected that the investigation is conducted expeditiously.

C. R. M. 3954 of 2020 and the connected application being CRAN 2180 of 2020 are disposed of.
