Judgment
State The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The
petition is taken up through video conference on the basis of such undertaking.
Having heard the learned Advocate for the petitioner and the Learned Public Prosecutor in-charge and on perusal of the materials on record, we do
not find any prima facie ingredient of offence under Section 307 or Section 354 of the Indian Penal Code. The alleged incident took place immediately
after the storm called ""Amphan"" over distribution of reliefs.
Considering entire circumstances, we are of the view that custodial interrogation of the petitioner is not necessary as long as he cooperates with the
investigation and reports to the investigating officer once in a fortnight and shall not leave the jurisdiction of the concerned police station, till the
investigation is complete.
In the event of arrest, the petitioner will be released on bail upon furnishing security of Rs.10,000/-(Rupees Ten Thousand) only together with personal
release bond of equivalent value to the satisfaction of the arresting officer.
The petitioner will abide by the conditions in Section 438(2) of the Criminal Procedure Code.
CRM 4928 of 2020 and CRAN 3135 of 2020 are disposed of.
