Judgment
Mr. Dastoor, learned senior counsel appearing for the petitioner submits that allegations are out and out false and the instant case has been instituted to exhort pressure upon his client. Civil proceedings are pending by and between the parties for a long time.
Mr. Ganguly, learned senior counsel appearing for the de facto complainant opposes the prayer for pre-arrest bail and submits that petitioner had forged and fabricated documents.
There is every possibility of tampering with evidence and abscondence.
Mr. Ruzzaque-ul-Ali-Ahmed, SI of Police, Detective Department, Anti-Fraud Section appears and submits investigation is in progress.
In view of the submissions made at the Bar, it appears there is a pending civil dispute by and between the parties. However, allegations with regard to lack of co-operation of the petitioner with the investigation of the case and apprehension with regard to his abscondence require to be immediately addressed.
Let this matter appear for further hearing on 2nd April, 2020.
Petitioner shall not be arrested in connection with this case till 6th April, 2020 or until further orders, whichever is earlier, on condition that he shall appear before the investigating agency on every Monday and Wednesday between 2.00 p.m. to 4.00 p.m. commencing from 23rd March, 2020 until further orders. Petitioner shall submit his passport, if any, on 23rd March, 2020 to the investigation agency.
Report with regard to progress of investigation be filed on the next date.
