Judgment
Ms. Vandana Sehgal, learned Amicus Curiae has placed before us a compilation of papers in English which includes (i) list of dates, (ii) F.I.R., (iii) affidavit of complainant before the Judicial Magistrate (First Class), Bilaspur and (iv) statement of complainant recorded before the Judicial Magistrate (First Class) on 11.8.2014. Having regard to the compilation of papers handed over by learned Amicus Curiae and the bunch of papers which the complainant handed over to us yesterday, we are of the view that a report from the Chief Judicial Magistrate, Bilaspur (Chhattisgarh) in the matter will help this Court in proceeding with the matter further.
The Registry is directed to send a copy of the compilation of papers handed over by learned Amicus Curiae and the paper book of suo moto writ petition to the Chief Judicial Magistrate, Bilaspur forthwith. The Chief Judicial Magistrate will forward a report to this Court in this regard as early as may be possible and positively within one week from the receipt of these papers.
We are informed by the learned Amicus Curiae that the complainant is presently admitted in Ram Manohar Lohia Hospital, New Delhi and according to the information received by her, it will take about 2/3 days before she is discharged and there is no body else in the hospital to her help.
In view of the above submission, we direct the Delhi Legal Services Authority to provide her necessary assistance so long as she is in Delhi. List the matter on 10.10.2014.
