Judgment
CA. No. 18lcBl202l,is an application filed by the Liquidator seeking the following reliefs: -
(i) Issue directions to the personnel and fficiats of the Petitioner Company to provide the requisite documents/information alongwith the signed copy of the Finqncial
Statements;
(ii) Issue directions to the personnel and fficials of the Petitioner Company to cooperatefor changing the authorised Signatory in the Bank Accounts of the petitioner
Company.
Subsequent, to the filling of the application hearing were conducted and the last such hearing took place today i.e., 13.07.2021 at which Mr.
Digamber Swain, Law officer, Cuttack Municipal Corporation, CS Saroj Ray and the Liquidator are present through video conferencing. It is
submitted that following the last hearing there were meeting of the Liquidator with the Commissioner and other high-ranking officials of the Cuttack
Municipal Corporation for tracing out the various pending issues. It is also submitted that atthe meeting it was assured that full co-operation shall be
extended hencefor""th to the Liquidator in due discharge of his duties. It is also submitted that a Senior Officer of the rank of Joint Commissioner has
been nominated to co-ordinate with the Liquidator so that the Liquidation process can reach its logical conclusion.
The Liquidator has no grievance at this moment as far as the Respondents are concerned. With this recorded, CA No. 1 }lCBlzO2l shall stand
disposed of accordingly.
Needless to say, in case there is any existence of non-cooperation in future the Liquidator is free to approach this Tribunal again for appropriate
reliefs.
