In the instant writ petition, the petitioner has sought for a direction against respondent No.1, to release the original educational certificates of the petitioner.

The petitioner was selected for M.D.S.Course in the institution of respondent No.1. The original educational certificates of the petitioner had been retained by respondent No.1. Now, the petitioner has been selected in the institute of respondent No.2 (AIIMS). It is alleged by the petitioner that the first respondent, without any valid reason, is refusing to release the original educational documents of the petitioner, submitted by him at the time of admission in the institution of the first respondent.

Having heard learned counsel for the petitioner, we are of the view that if any formalities need to be completed and any amount of fees etc. is due to be paid by the petitioner, as per the regulations of the first respondent, he is liable to pay the said amount in favour of the first respondent for getting his original educational documents. It is, therefore, open to the petitioner to pay such an amount, if any, as per the regulations of the first respondent, and thereafter seek for release of his original educational documents.

We accordingly direct respondent No.1 to immediately release the original educational documents of the petitioner, after completing all the formalities and clearing all the dues, as per the regulations of the first respondent, without any delay.

With these observations, the writ petition stands disposed of.
