Judgment
The Court: This is an application for amendment of the petition filed under Section 11 of the Arbitration & Conciliation Act, 1996.
It appears that subsequent to the filing of the petition, IFGL Refractories Limited (the petitioner in AP 415 of 2017) has amalgamated with the
petitioner in terms of the order dated 3rd August, 2017.
The registered office of the petitioner has also shifted from 3, Netaji Subhas Road, Kolkata-700001 to Sector “Bâ€, Kalunga Industrial Estate, P.O.
Kalunga-700031, Odisha on and from 24th November, 2017. Pursuant to such change, a certificate of change of the registered office has been issued
by the Registrar of Companies at Cuttack. Under such circumstances, this
application for amendment has been taken out by the petitioner. The application, being formal in nature, is allowed.
There shall be an order in terms of prayer ‘a’, ‘b’ and ‘c’ of the notice of motion. GA 478 of 2018 stands disposed of. However,
there shall be no order as to costs.
