Judgment
This Appeal has been filed against order dated 23.09.2021 passed by the Adjudicating Authority on M.A. No. 3545/2019. The M.A. was filed by the Appellant seeking direction against the Resolution Professional for admission of claim as per Form C. The said application came to be dismissed by the impugned order by the Adjudicating Authority.
Learned counsel for the Respondent submits that the Resolution Plan which was already approved by the CoC has been approved by the Adjudicating Authority on 11.03.2022. It has been further submitted that implementation of the plan has also begun.
We have noticed the aforesaid submission in our order dated 27.04.2022. We are of the opinion that in view of the subsequent events i.e. approval of Resolution Plan on 11.03.2022, this Appeal has become infructuous.
Learned counsel for the Appellant submits that Appellant may be given liberty to challenge the order dated 11.03.2022. We are of the view that in the present Appeal no such liberty is required to be given. It is always open for the Appellant to challenge the order in accordance with law. Appeal is dismissed with these observations.
