Judgment
The present appeal bearing No.343/2023 is filed to impugn the final order dated 20.20.2022 passed by DRT-II, Delhi in O.A. No.820/2016. The appeal was ordered to be dismissed in default vide order dated 08.04.2024. Thereafter the appellant filed Misc. Application bearing no.47/2024 for restoration of the appeal which was dismissed in default on 08.04.2024. Misc. Application bearing no.47/2024 was also dismissed in default vide order dated 28.05.2024. The appellant then filed a Misc. Application No.85/2024 for restoration of Misc. Application No.47/2024 which was again dismissed in default on 16.04.2025. Thereafter, the present Misc. Application bearing no.148/2025 is filed.
Sh.Avinash Das, Advocate appearing for the applicant/appellant stated that the absence of the advocate was neither deliberate and intentional but due to the reasons stated in the applications.
This Tribunal is not impressed and convinced by the pleas taken in the applications as referred hereinabove, for restoration of the present appeal. It is pertinent to mention that Vakalatnama on behalf of the appellant has been filed by as many as 8 advocates, but none of them appeared. However, in the interest of justice and after considering all facts, the Appeal bearing no.343/2023 is ordered to be restored to its original number subject to costs of Rs.20,000/- to be paid to DRAT Bar Association in A/c No.15530110132692 (IFSC:UCBA0001553) maintained with UCO Bank, Delhi High Court branch within 15 days and the receipt thereof be produced on the next date of hearing.
I.A. No.836/2025 (application for condonation of delay)
The instant application is filed to condone the delay in filing the present Appeal bearing no.343/2023. However, the number of days for which the application for condonation of delay has been mentioned. After considering all facts the delay, if any, filing the present appeal stands condoned.
