Judgment
Admit. No notice need be issued as respondent is represented by Mr. Dhruv Tamta, Advocate on advance notice.
Heard learned senior counsel for the petitioner and learned counsel for the respondent.
The main plea of the petitioner is that it is also a Telecom Service Provider (TSP) having Unified License with VSAT authorisation and is therefore, covered by the Cabinet Policy Decision contained in Annexure P/2 posted on 15.9.2021.
In view of the aforesaid stand, petitioner has assailed the decision of DoT dated 7.12.2021 (Annx. P/1) whereby it has been informed that the AGR moratorium applies only to the TSPs having Access Service License which are not under CIRP or related litigation or closed down (under liquidation or liquidated).
On behalf of respondent a prayer has been made for a short adjournment to seek instructions and if possible to file a short reply to explain the stand taken in the impugned decision.
As prayed, post the matter under the head "for directions" on 7.3.2022
Although petitioner has pressed for interim relief, it appears that time to pay the demands extends till 31.3.2022. Hence, such prayer can be considered on the next date.
