ORDER

PER: SH. L. N. GUPTA, MEMBER (T)

The present Application is filed by HSCC (India) Limited [Respondent in (IB)-1333(ND)2019] under Section 60(5) of IBC, 2016 against M/s Kalpataru Power Transmission Limited [Applicant in (IB)-1333(ND)2019] seeking the following reliefs:

a)

“Allow the present application and dispose of the captioned application under Section 9 of the Insolvency and Bankruptcy Code filed by the Operational Creditor.

b)

Pass such other orders as may be deemed fit, proper and necessary by this Hon’ble Tribunal.”

The documents annexed in the captioned IA are taken on record and considered while adjudicating (IB)-1333(ND)2019.

The prayer (a) made in the captioned IA has become infructuous in view of the separate order passed in Company Petition (IB)-1333(ND)2019 on 24.07.2023.
