Judgment
Ajay Mohan Goel, J
With the consent of the parties, the appeal is taken up for hearing today itself.
Learned Counsel for the parties are AD IDEM that the issue raised in this appeal is squarely covered by the judgment passed by Hon'ble Coordinate Bench of this Court in RFA No. 368 of 2014, titled as The Himachal Pradesh Power Corporation Limited and another versus Narayan Singh and others, decided on 12.10.2018 and other connected matters and pray that this appeal be disposed of with the direction that the findings so returned by Hon'ble Coordinate Bench shall mutatis mutandis applies to this appeal also.
In addition, Mr. Vivek Negi, learned Counsel for the appellant submits that in the judgment which stood passed by Hon'ble Coordinate Bench referred to above, categorization of the land was done in three categories and the land involved in the present appeal falls in category 'B' as done in the judgment (supra).
Learned Counsel for respondent No. 1 concurs with the submissions so made by Mr. Vivek Negi, Advocate.
Accordingly, this appeal is disposed of with the direction that findings returned by Hon'ble Coordinate Bench of this Court in RFA No. 368 of 2014, titled as The Himachal Pradesh Power Corporation Limited and another versus Narayan Singh and others, decided on 12.10.2018 and other connected matters, shall mutatis mutandis apply to this appeal also in general and paragraphs 101 and 102 in particular and all directions so issued by Hon'ble Coordinate Bench shall be construed as having been issued in this appeal also. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
