The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to release payment of Rs. 14.03,658/-including security with respect to work carried out by it for the respondent along with interest @ 12% per annum.
Learned State counsel on instructions from Mr. Keval Garg, Executive Engineer, Division No.2, Sri Muktsar Sahib submits that admitted liability to the tune of Rs. 8.68 lakhs is outstanding which would be released within three months from today.
Learned counsel for the petitioner agrees to the aforesaid arrangement.
In the wake of statement of both sides, the petition stands disposed of with a direction to respondent No.4 to release payment to the petitioner within three months from today along with interest @ 6% per annum from the date of passing bills. It is made clear that if payment is not released within aforesaid period, the rate of interest would be 9% from the expiry of said period.
