Learned Additional Advocate General has placed on record instruction memo dated 15.03.2023, issued by the Director Elementary Education, Himachal Pradesh to the office of learned Advocate General. The instruction memo, inter alia, states as under:-
“In compliance to the order of the learned Administrative Tribunal dated 20.07.2017 the matter has been taken up with the Government of Himachal Pradesh vide letter No. EDN-ELM-H(3)-C(10) COPC (T) No. 1084 of 2020 dated 12th May, 2023, for necessary approval to release the pension in favour of the petitioner/respondent subject final outcome of the WEP No. 2944/2018 tilted as State of Himachal Pradesh & Ors Vs. Sh. Hoshiar Singh.
It is further requested that necessary approval/sanction to release the interest on delay payment of Death-Cum-retirement gratuity in favour of the petitioner amounting to Rs.1,54,806/- (Rs. One Lakh fifty four thousand eight hundred and six) only has been accorded to the quarter concerned vide Office Order No. EDN-ELM-H(3)-C(10) COPC(T) No.1084/20-20 dated 12th May 2023 and the copies of the same are enclosed for kind perusal.”
Since the respondents are now proceeding to implement the judgment in question subject to the final outcome of CWP No. 2944 of 2018, nothing survives for adjudication in the present contempt petition. Accordingly, the proceedings are closed. Notices issued to the respondents are discharged. However, liberty is reserved to the petitioner to seek appropriate remedy in accordance with law at an appropriate stage for the survival of his remaining grievances, if any. The Pending miscellaneous application(s), if any, also stand disposed of.
