Rajiv Sharma, J.—Petitioner has served a legal notice on the respondents vide Annexure A-6, dated 22nd October, 1998. In sequel thereto, the Chief Executive Officer, HIMURJA has filed the reply vide Annexure A-1, dated 28th November, 1998, which reads thus:

In this context, it is to inform you that as per R&P Rules the method of recruitment for the post of Project Officer is 50% by direct recruitment and 50% by promotion. The promotion of your client falls under promotional quota and he will be considered against the same according to the seniority; whereas Mr. Vineet Sood has been absorbed against direct recruitment. In view of the position explained above, you are requested kindly to apprise your client accordingly.

Mr. S.R. Sharma, learned Counsel for the petitioner prays for and is permitted to withdraw the present petition, with liberty reserved to the petitioner to seek appropriate remedy in accordance with law before the appropriate Court. Mr. R.P. Singh, learned Assistant Advocate General submits that the ground of limitation will not come in the way of the petitioner in case he institutes a suit claiming damages, if any.

Accordingly, the petition is disposed of as withdrawn, with the observations made hereinabove.
