Judgment
This bail application is filed under Section 439 of the Code of Criminal Procedure, passed by learned Additional Sessions Judge, District- Gariyaband,
in connection with Crime No. 29/2021, at Police Station- Mainpur, District- Gariyaband (C.G.) for the offence punishable under Section 420 of I.P.C.
Counsel for the applicant submits that the applicant highly diabetic patient, he depends over the insulin two times in a day, medical report of the
applicant is annexed as Annexure A/2, he is aged about 31 years, he is jail since 22.03.2021 and challan has already been filed, he is in high risk during
this Pandemic situation, therefore, he be released on ad-interim bail.
Learned counsel for the Non-Applicant/State not opposes the contention made by learned counsel for the applicant.
Considering the facts and circumstances of the case, health condition of the applicant, the fact that applicant is high diabetic patient, detention period
of the applicant, without commenting anything on merits of the case, the application (I.A. No.1/2021) for grant of ad-interim bail to the applicant is
allowed.
It is directed that the applicant shall be released on ad-interim bail, it is directed that in the event of the applicant executing a personal bond for a sum
of Rs. 50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court.
It is made clear that this order shall be operative till 15.07.2021. Thereafter, the applicant surrender on the said date before the concerned Court.
He shall strictly follow the COVID-19 protocol issued by the Central Government/State Government/Local Authority, he shall not involve himself in
any offence of similar nature in future or else this order granting bail to the applicant shall automatically stand cancelled without further reference to
the Bench.
List the case for final hearing on 20.07.2021.
