By way of present petition, the petitioner has prayed proceedings for contempt to be initiated against the respondents as the respondent No.2 has tried to get mutation in her name and respondent No.1 despite being aware of the interim order is going to mutate the land in the name of respondent No.2.
In support of his contention aforesaid, the petitioner has placed on record the proceedings of Case No.05/2017 (Annexure-3).
Learned counsel for the respondents invited Court’s attention towards the reply and copy of the proceedings filed therewith and submitted that the same were taken under misconception of law and Tehsildar, who was unaware of the stay order has later dropped the proceeding on 23.01.2018.
On perusal of the order-sheet dated 23.01.2018 (Annexure-NA/2), this Court finds that the proceedings in question have been kept in abeyance till disposal of the S.B. Civil Misc. Appeal No.798/2015.
In view of the aforesaid, this Court does not wish to continue with the proceeding of contempt initiated against the respondents.
Notices of contempt are, hereby, discharged.
The present contempt petition stands disposed of accordingly.
