Per: SANJIV JAIN, MEMBER (JUDICIAL)

This is an Application filed by the Applicant under Section 60(5) of Insolvency and Bankruptcy Code, 2016 seeking relief as follows;

(i)

condoning the delay of 54 days in submission of claim in Form-B filed by the Applicant; and consequently directing the Respondent/Interim Resolution Professional to

(ii)

take on record and admit the claim of Rs. 16,03,658/- (Rupees sixteen lakhs three thousand six hundred and fifty eight only) legally due to the Applicant from M/s. Nucleus Satellite Communications (Madras) Private Limited during the period 26/06/2019 till 28/09/2019;

(iii)

pass any order as this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the present case

This Tribunal vide its order dated 12.09.2023 passed in IA(IBC)/1515/CHE/2023 has ordered for Liquidation of the Corporate Debtor viz. M/s. Nucleus Satellite Communications (Madras) Private Limited and appointed Mr. Ramakrishnan Sadasivan as the Liquidator.

Under the circumstances, we dispose of this Application, with a direction to the Applicant to lodge the claim before the Liquidator within the time limit as specified under the provisions of the I&B Code, 2016, and IBBI (Liquidation Process) Regulations, 2016.

With the above directions, these Application stands disposed of.
