Judgment
THE complainants are flat owners who have joined the scheme organised by the opponents. Though the opponents have given possession of the flats to the respective complainants, the work was incomplete and, therefore, the complainants alleged that there was deficiency in service in-as-much as the work that was undertaken and promised had not been done by the opponents.
THAT since the parties had arrived at a compromise and M/s. Viast Corporation had agreed to complete the work the case was adjourned from time to time so that the complainants can get their flats completed by the opponents. Now sufficient time has passed. Mr. Joshi, the learned advocate appearing on behalf of the opponents produces 17 purshishs of 17 complainants who have stated that so far their flats are concerned the work has been completed. In this matter there are 22 complainants. That means that the flats of 5 complainants viz. the complainants at Sr. No. 3 (Rameshbhai hambhubhai Patel), Sr. No. 14 (Dhirubhai S Patel), Sr. No. 19 (Prakashsinh Mengaram Rahi), Sr. No. 20 (Gopalkrishna Shankaran Menon) and Sr. No. 21 (Laxmanbhai C Panchal) have not been completed.
Mr. Joshi assures us on the instruction of his clients that the opponents will carry out the remaining work as done in other 17 cases and, therefore, he further states that the complainants have agreed and prays that the matter may be disposed of accordingly.
MR. Bhatt the learned Advocate appearing on behalf of the remaining 4 complainants states that he has no instructions. However he relies upon MR. Joshi and states that the matter being very old the same may be disposed keeping the right of these five complainants alive. He further states that liberty may be given to these five complainants to approach this Commission again. All the17 purshishes are taken on record. ORDER The complaint is disposed of as settled with liberty to the aforesaid complainants to move this Commission in the case of non-compliance of the assurance given by the Opponents. In the circumstances there will be no order as to costs. Complaint disposed of.
