Judgment

The communication assailed by way of present writ petition is passing permission granted by the Regional Transport Authority, Shimla, dated 04.01.2020 pertaining to a Bus owned by the present petitioner.
In the considered view of this Court, this writ petition is not maintainable before this Court because the petitioner has statutory remedy as provided under the Himachal Pradesh Motor Vehicle Rules, 1999 framed under the Motor Vehicles Act, 1988.
At this stage, learned Counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to approach the statutory authority with regard to the grievance raised by way of this petition. The petition is permitted to be withdrawn with liberty as prayed for. It is clarified that in case the petitioner approaches the authority concerned within 30 days from today for the redressal of the grievance raised by way of this petition, then the issue of limitation shall not be raised by the respondents and the case shall be heard and decided on merit.
The petition stands disposed of in above terms, so also pending miscellaneous application(s), if any.
