Judgment
Rajiv Narain Raina, J.—This order shall dispose of CR No. 6691 of 2013 titled Hindustan Petroleum Corporation Limited vs. Sant Lal and another & CR No. 580 of 2014 titled Hindustan Petroleum Corporation Limited vs. Sant Lal and others.
This case does not fall in the exception carved out by the Supreme Court in Gurpreet Singh Vs. Union of India (UOI), . The exception laid down is that a decree-holder would be entitled to appropriate land acquisition compensation on the general principle of appropriation, first towards interest, then towards costs and then towards the principal, unless, of course, the deposit is indicated to be towards specified heads by the judgment debtor while making the deposit intimating the decree-holder of his intention. The Constitution Bench in Gurpreet Singh''s case has approved the ratio of the earlier decision of the Supreme Court in Prem Nath Kapur and Another Vs. National Fertilizers Corpn. of India Ltd. and Others, . In view of this legal position, the fate of the petitions is sealed.
Dismissed.
