Judgment
THIS is an application for condonation of considerable delay in preferring the appeal. The order of the District Forum, Hisar is dated the 5th of August, 1992 whilst the appeal has been filed before this Commission on the 16th of September, 1992. There is thus a delay of 13 days beyond the strictly prescribed period of thirty days under Section 15 of the Act.
THE solitary ground raised in the application is that the appellant was under a mistaken belief that the limitation for filing the same is to run from the date of the alleged receipt of a copy of the order. This plea within this jurisdiction has only to be noticed and rejected. It has been authoritatively held in I (1992) CPJ 359, Haryana State Electricity Board v. Dinesh Kumar that the terminus for computing the period of limitation under Section 15 is the firm date of the order and not any supposed date of the receipt of a copy thereof. This view has now held the field consistently within this jurisdiction for a considerable time. Consequently, the plea of some mistaken belief to the contrary cannot be entertained, particularly in the absence of any affidavit of a Counsel on the point of rendering any erroneous legal advice. For the foregoing reasons, we are unable to find any merit in this application which is hereby dismissed. Inevitably, the appeal also fails on the preliminary bar of limitation.
