IT is petitioner who was the opposite party before the District Forum. Complaint by the first respondent is that in the bottle of coke, there was some foreign particle. District Forum after considering the whole aspect of the matter awarded compensation of Rs. 2,500/- and costs of Rs. 500/- to the petitioner who is the manufacturer. The agent who sold the bottle was let off. District Forum was of the view that no evidence has been furnished. In this view of the matter only nominal amount was awarded. Appeal filed before the State Commission was barred by limitation. There is a delay of 133 days. The ground sought for condonation of delay is that the Clerk had lost the certified copy. The State Commission did not accept this ground. Parties should have been very vigilant and appeal should have been filed within the time. No grounds for us to interfere with the order passed by the State Commission. Revision Petition is dismissed on the ground of limitations. Revision Petition dismissed.
