Judgment
Ravindra Maithani, J
Applicant Himanshu is in judicial custody in FIR No.535 of 2023, under Sections 307, 323, 504, 506 read with Section 34 IPC and Section 25 of the Arms Act, 1959, Police Station Rishikesh, District- Dehradun. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
It is argued by learned counsel for the applicant that co-accused, having similar role, has already been granted bail; applicant is not a previous convict.
Learned State Counsel would admit the parity, but she would submit that the applicant has been involved in some other cases in the past, though she admits that applicant is not a previous convict.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
