Judgment
V.K. Sharma, J.—The present contempt petition arises out of order dated 18.2.2009, passed by the learned Vacation Judge, in CMP No. 731 of 2009 (CWP No. 406 of 2009), whereby operation of order dated 28.1.2009 (Annexure P-XVI filed with the writ petition) qua Respondent No. 4, who is Respondent No. 2 herein, was stayed till further orders.
An affidavit stating that the a foresaid order dated 18.2.2009, which could not be implemented earlier due to some communication gap has since been implemented. As far as delay in implementing the order is concerned, unconditional apology has been tendered on behalf of all the Respondents. A perusal of the affidavit filed on behalf of Respondent No. 1, would go to show that the aforesaid order dated 18.2.2009, out of which present contempt petition has arisen, has since been implemented and the impugned order dated 6.4.2011, has since been withdrawn with immediate effect.
In view of the above, the contempt petition is closed discharging the notice.
