By way of this application, the applicant-under trial prisoner has prayed to release him on temporary bail for 45 days on the ground of illness of his
wife.
When the matter was taken up for hearing, learned advocate Mr. Patel for the applicant stated he does not press this application insofar as the
reason stated in Ground-P of the Memo is concerned wherein, it is stated “that the applicant is a heart patient who has undergone angioplasty and
owning to the present Covid-19 pandemic situation, the applicant is required to go for follow up medical check-upsâ€.
The learned advocate for the applicant stated that he presses this application only on the ground of illness of his wife. In support of the submission,
a copy of the Certificate dated 27.05.2021 issued by Dr. Narendra R. Shah, Consulting Physician has been produced. In the said Certificate, the
Doctor concerned has recorded that the patient is found to have suffered severe weight loss with Anorexia and Post Enteric Fever and has been
advised further investigations and rest for three weeks.
In the said Certificate, no where the Doctor has stated that the wife of the applicant requires to undergo any surgery / operation in the immediate
future. Hence, the ground narrated by the applicant of illness of his wife does not inspire any confidence. Thus, the application is rejected.
