Mr. Anshul Bansal, learned counsel representing the respondent states that reply stands filed on behalf of the Central Bureau of Investigation, but the same is not on record. Registry to trace and place the same on record, if in order.
Mr. Anshul Bansal, learned counsel representing the respondent while inviting attention of this Court to the provision of Section 52(a)(1) of the Indian Forest Act, contends that present petition is not maintainable because application, if any, for the release of vehicle impounded by the police in connection with criminal case can be filed before the authorized Officer.
In view of the aforesaid objection raised by learned counsel representing the respondent, learned counsel representing the petitioner seeks permission to withdraw the present petition with liberty to file appropriate proceedings before the competent authority. Ordered accordingly.
Needless to say, authorized Officer in the event of filing application, if any, by the petitioner for release of the vehicle, shall dispose of the same expeditiously, preferably within a period of one month from the date of filing of the application. The petition stands disposed of.
