This criminal revision is preferred under section 19(4) of the Family Courts Act, 1984 read with section 438 and 442 of the Bhartiya Nagarik Suraksha Sanhita, 2023 challenging the legality of impugned order dated 11.10.2025 in MJC (Cri.) No.266/2024 by the Principal Judge, Family Court, Ratlam (M.P.) whereby the right to defense has been struck off for non¬compliance of order dated 19.09.2025 in Criminal Revision No.4579/2025 and Criminal Revision No.3562/2025 whereby the revision petitioner was directed to deposit the amount of interim maintenance within 15 days from today, then the family court was requested to take appropriate steps including striking off the defense in case of non compliance of the order.
The amount was deposited with a delay of 3 days on 08.10.2025.
Counsel for the revision petitioner submits that reasonable cost may be imposed for the delay caused in the deposit of amount.
Considering the factual position of the case, a cost of Rs.15,000/- (Rupees Fifteen Thousand only) is imposed which shall be paid by the revision petitioner till 10.11.2025 . In case of deposition of cost, order dated 11.10.2025 be treated as modified and the order of striking off the defense would be treated as non existent. In case of any default, order shall remain effective. The cost be paid to respondent/wife (Smt. Shailja).
