(Interim Relief Application No. 8879 of 2010)

Heard learned Counsel for the parties and perused the record.

By means of this writ petition, the Petitioner has sought a writ in the nature of certiorari quashing the order dated 21-8-2009 passed by Respondent No. 3 annexed as Annexure No. 5 to the writ petition. The Petitioner has further sought a writ in the nature of mandamus directing the Respondent authorities to restore the registration of the firm of the Petitioner in Nagar Nigam Dehradun in view of the investigation report dated 5-6-2010 submitted by investigation officer in favour of the Petitioner.

The grievance of the Petitioner is that the registration of the firm of the Petitioner has been wrongly cancelled by the Respondent No. 3 and the Petitioner firm has wrongly been blacklisted.

During the course of arguments, learned Counsel for the Petitioner has urged that the Petitioner had already made a representation to the Up Nagar Adhikari, Nagar Nigam, Dehradun and the same is still pending for disposal. The ends of justice would be served if the Respondent-authority is directed to decide the representation of the Petitioner (Annexure 11 to the petition) by a speaking and reasoned order. Prayer is innocuous.

Accordingly, it is directed that the representation of the Petitioner (Annexure-11 to the writ petition) shall be decided by the authority concerned by a reasoned and speaking order expeditiously, preferably within a period of eight weeks from the date of production of a certified copy of this order.

With the above direction, the writ petition is disposed of finally.
