Judgment
The applicant as also the respondent have preferred the applications for modification of interim order dated 17.8.21 passed by this Court to the extent of granting three weeks time to the parties to file Affidavits of Disclosure of Assets and the Liabilities in the format Enclosure-I, set out in the decision of the Hon'ble Supreme Court in Rajnesh Vs. Neha & Anr. : (2021) 2 SCC 324.
Learned counsel appearing for the applicant-Smt. Hemlata submits that the applicant met with an accident and therefore, she could not file the affidavit within the stipulated time.
Learned counsel appearing for the respondent submits that both the parties were granted time to file the affidavits. It is submitted that since the period of three weeks has expired, the Family Court is not accepting the affidavits.
Thus, on the facts and in the circumstances of the case, the order dated 17.8.21 passed by this Court is modified to the extent that the parties may file their comprehensive affidavits, as directed by this Court on or before 28.10.21.
It is pertinent to note that vide order dated 17.8.21, the Family Court was directed to decide the application seeking maintenance within a period of two months.
In view of change circumstances, the order passed by this Court as aforesaid, the period for decision of the application also deserves to be extended.
Accordingly, it is directed that after submission of the affidavits filed by the parties, the Family Court shall decide the matter expeditiously in any case before 25.11.21.
The applications stand disposed of.
