Judgment
Heard on I.A. No.01/2021, an application for grant of interim protection.
The applicant has preferred the first bail application under Section 438 of the Cr.P.C. for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.155/2021, registered at Police Station - Bhilai Nagar, District - Durg (C.G.) for the offence punishable under Section 376 of the Indian Penal Code.
In this MCRCA, the applicant has filed an application for grant of interim protection (I.A. No.1/2021) mentioning that marriage of applicant's sister - Monika Rani, is to be held on 18-11-2021, therefore, applicant may be granted temporary protection for the period of 17-11-2021 to 19-11-2021.
Learned counsel for the applicant submits that marriage ceremony of applicant's sister-Monika Rani is scheduled to be held on 18-11-2021 at Chawda Bhawan, Durg (C.G.). Ceremony of marriage are going to start from 17-11-2021. The applicant has also filed photocopy of marriage card. Hence, he prayed that the applicant may be granted interim protection for the period of 17-11-2021 to 19-11-2021 to attend marriage ceremony of his sister.
Learned counsel for the State submits that he has verified the fact of aforesaid marriage ceremony of applicant's sister-Monika Rani (Bride), which is to be held on 18-11-2021 at Chawda Bhawan, Durg (C.G.), therefore, he has no objection if the applicant is granted temporary protection.
Considering the submissions made by learned counsel for both the parties, It is directed that no coercive steps should be taken against the applicant from 17-11-2021 to 19-11-2021.
Accordingly, the I.A. No.01/2021, application for temporary protection is allowed.
