Prayer in this petition filed under Section 482 Cr.P.C. is for grant of permission to petitioner Hemant Goyal to go abroad on account of his business
commitments based on the invitations (Annexure P-5) received from foreign business houses, in FIR No.1578 dated 24.11.2015 under Sections 420,
467, 468, 471 and 120-B IPC registered at Police Station City Panipat, District Panipat.
Learned State counsel has taken a preliminary objection regarding maintainability and after having instructions from Inspector Satyavir Singh, argued
that instead of approaching the trial Court for the relief claimed, the petitioner has straightway rushed to this Court.
Faced with this situation, learned counsel for the petitioner wishes to withdraw the present petition so as to approach the trial Court for the relief
claimed in the present petition.
Dismissed as withdrawn.
In case the petitioner approaches before the trial Court within a week from today, the trial Court shall take a final call on his application preferably
within a period of seven days from the date of filing of such application.
