Judgment
Wife has filed this appeal challenging the divorce decree passed by learned Additional Principal Judge, Family Court, Kashipur in Family Suit No. 235 of 2019, Chandra Shekhar Joshi v. Hema Joshi. Appeal was admitted and notice to respondent-husband was issued.
Today, both parties are physically present in the Court along with their respective Counsel.
Mr. B.D. Pande, appearing for appellant-wife, submits that all differences between the parties have been resolved and they decided to live together and now they are living together since 10.2.2026. Thus he submits that appeal can be decided in terms of the compromise, which is made part of IA No. 04 of 2026.
Mr. Mohd. Shafy, appearing for the respondent-husband, endorses the statement made by Mr. B.D. Pande and submits that his client has instructed him that he is living happily with the appellant and, therefore, appeal can be decided in terms of the compromise, which is made part of the record.
We have also interacted with the parties. Appellant and respondent, both have stated that they are happily living together and there is no difference or dispute remaining between them. They also prayed that the appeal be decided in terms of the compromise.
In such view of the matter, impugned divorce decree, passed by Additional Principal Judge, Family Court, Kashipur in Family Suit No. 235 of 2019 is set aside and appeal is decided in terms of the compromise, which shall form part of this order.
