Judgment

[1] Heard learned counsel for the respective parties.
[2] The present application has been filed under Article 226 (3)(b) of the Constitution of India read with Order XXXIX Rule 4 read with section 151 of the Code of Civil Procedure, 1908 and under Chapter- VIII (3)(b) of the High Court of Tripura Rules, 2023, for vacation/ modification of the interim order dated 28.05.2025 passed in I.A. 01 of 2025.
[3] Mr. T.D. Majumder, learned senior counsel for the applicant submits before this Court that the interim stay granted by this Court in order dated 28.05.2025 passed in IA No.01 of 2025 in WP(C) No.297 of 2025 be vacated. It is submitted that in pendency of civil suits, the status quo order dated 05.08.2017 (Annexure-9 to the writ petition) does not preclude the concerned authorities from correcting Khatian entries. It is further contended that the status quo order is limited to maintaining the physical possession as on 05.08.2017 and does not extend to revenue records or bar statutory corrections under the TLR LR Act.
[4] Per contra, Mr. S. Kar, Bhowmik, learned senior counsel for the petitioner in writ petition (respondent herein) reiterates his argument and pressed to make the interim order dated 28.05.2025 passed in IA No.01 of 2025 in WP(C) No.297 of 2025 absolute and to dismiss the instant IA.
[5] Prima facie, this Court is of the considered opinion that since the dispute between both the parties relates to a subject-property which is sub-judice by the concerned Court and an order of status quo has been passed on 05.08.2017 in Civil Misc (Inj) 34 of 17 (Annexure 9 to the writ petition) and the applicant herein, namely Smt. Helen Rani Roy, approached the Court of District Collector seeking an intervention of revenue entries regarding the same disputed property, it is not proper for the concerned official respondent to interfere with the status quo order passed by the concerned Court and accordingly, the instant application for vacation/ modification of the interim order dated 28.05.2025 passed in I.A. 01 of 2025, stands dismissed.
[6] With the above observation, the interlocutory application stands dismissed and disposed of.
