Judgment
The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioners, who are in custody in connection with F.I.R. No.260/2017 registered at Police Station Gulabpura, District Bhilwara for the offences under Section 147, 323, 325, 452 & 307 of IPC.
Heard learned counsel for the petitioners and learned Public Prosecutor.
It is submitted that specific allegation for inflicting head injury is against, Uda and so far as petitioners are concerned, omnibus allegations are levelled, therefore, the petitioners may be released on bail.
Learned Public Prosecutor vehemently opposed the prayer of the learned counsel for the petitioners.
Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced at the bar, this Court is of the opinion that the bail application filed by the petitioners deserves to be accepted.
Consequently, the bail application is allowed. It is ordered that the accused-petitioners, (1) Heeralal S/o Shri Gangaram Ji,
(2) Sukhdev S/o Heeralal Gurjar, (3) Jethu S/o Heeralal Gurjar, and (4) Rameshwar S/o Heeralal Gurjar, arrested in connection with F.I.R. No.260/2017 of Police Station- Gulabpura, District Bhilwara, shall be released on bail; provided they furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
