Judgment
08.09.2026 : This appeal is filed against an impugned order dated 21.08.2026 passed by the Ld. Adjudicating Authority (National Company Law Tribunal, Kolkata Bench, Kolkata), in 3 Intervention Applications viz. INV.P. (IBC)/20(KB)/2026, INV.P. (IBC)/14(KB)/2026 and INV.P. (IBC)/22(KB)/2026.
It is submitted by the learned counsel for the appellant, an application under Section 12A of the IBC was filed on behalf of the CoC by the Resolution Professional, which is I.A. No.681/2026 and it was heard by the Ld. NCLT and was reserved for orders.
It is submitted, in the meanwhile the abovesaid Intervention Applications were moved by one operational creditor and two prospective resolution applicants and the Ld. Adjudicating Authority has now fixed the matter on 21.09.2026 for hearing on those applications by keeping the orders on application under Section 12A pending.
It is the submission, let there be a direction to the Ld. Adjudicating Authority to take up these applications on the same day and to hear it and dispose it of in a timely manner.
We have also heard learned counsel for the Respondents.
In the circumstances stated above, it would be appropriate to dispose of the appeal by making a request to Ld. Adjudicating Authority to take up the above applications with connected one(s) and to hear the applications on 21.09.2026 and to dispose it of in a timely manner, more preferably within three weeks from the said date.
The appeal is disposed of. Pending applications, if any, are also disposed of.
