The short grievance of the petitioners is as to their names not being included in the Voters List thought they have been allegedly admitted to Membership vide Resolution dated 12.08.2018 by the then Managing Committee.
Learned counsel for the petitioners submits that in W.P.No.7707/2020, a Coordinate Bench of this Court has directed holding of the elections to the second respondent - Society in terms of the undertaking given by the Administrator; he adds that the Administrator, unjustifiably, had told the Coordinate Bench that he would not include names of the petitioners in the Voters List; petitioners herein not being parties to the said writ petition. Be that as it may.
Learned HCGP on request having accepted notice for the respondent Nos. 1 & 3, notice to respondent No.2 being dispensed with, opposes the writ petition contending that a Writ Court is not meant for the redressal of a grievance of the kind; having said that, she fairly submits that if a reasonable period is prescribed by this Court, there would be no difficulty for the answering respondent No.3 to consider petitioners' representation, wherein they have sought for inclusion of their name as voters.
In view of the above, this writ petition is disposed off directing the third respondent to consider petitioners' claim for inclusion of their names in the Voters List in terms of a fresh representation to be made by them within one week and inform the result thereof within the next two weeks thereafter.
The election in terms of his undertaking given in the cognate writ petition shall not be held till after a decision taken on their representation is conveyed to the petitioners and one week lapses thereafter.
All contentions are kept open.
No costs.
