Petitioner is the grandmother of the children whereas the mother of the children is working abroad. Respondent, husband, Muhammed Aneez preferred GOP No.2091 of 2023 for seeking custody of the children. In the aforementioned proceedings, petitioner had appeared on 17.2.2024 and was ordered to appear on 24.2.2024 along with the children. Appellant, petitioner was stated to be unwell as per the medical certificate Ext.P2 and could not appear on 24.2.2024.
Learned counsel for the petitioner submitted that on the last date of hearing ie., on 24.2.2024, the Family court has ordered the production of the children through police. Petitioner undertakes to appear before the Family Court along with the children subject to any conditions for the purpose of visitation rights and adjudication of the interim application in the pending matter.
We have heard the learned counsel for the petitioner. We deem it appropriate to dispose of the writ petition without issuing notice to the other side to defray the cost of litigation and delay in further proceedings and permit the petitioner to appear and produce the children on 29.2.2024 without the aid of the police.
