Judgment
M.M. Kumar, J.—This order shall dispose of LPA No. 1082 of 2010 and LPA No. 1083 of 2010 as both the appeals have arisen out of the same impugned order dated 14.1.2010 passed by the learned Single Judge. The appeals are directed against an interlocutory order dated 14.1.2010, passed by the learned Single Judge, dismissing the application of the appellant for vacation of the interim order vide which the order passed by the Boards of Director inflicting the punishment of stoppage of increment with cumulative effect, has been stayed.
The dispute before the learned Single Judge, inter alia is whether the second appeal against the decision of the Managing Director would be permissible in the face of Rule 12 of the Haryana Civil Services (Punishment and Appeal), 1987. Learned Single Judge has directed that the matter be posted for disposal within a period of two years.
Having heard learned Counsel for the appellants and taking into account the chorological facts, we are not inclined to interfere with the interlocutory order passed by the learned Single Judge. However, we modified the order of the learned Single Judge and direct the registry to post the case for hearing on 1.11.2010.
